I have started a company two years back however due to my health issues i never did a single compliance. its a new and fresh company i need some one to guide me and let me know how to clear all dues. I have not done a single transaction in it. it was started and kept as it is
Thanks for your query. We assume this is a section 8 company (charitable object) that is being referred.
- If you wish to continue with the company, please complete pending annual filings on MCA portal. These forms would necessarily include AOC-4-audited financial statements, MGT-7-Annual Return, DIR-3-Director KYC, ADT-1-Auditor appointment and ITR-6 on IT portal. All these filings will entail penalty. A registered professional will help you with these filings, and you are good to begin.
- If you do not wish to continue with the company, apply for strike off in Form STR-2 with required documentation and formalities.
- If you are uncertain about continuing with the company, until then you can apply for dormant status without penalty prospectively filing Form MSC-1 since there is hardly any transaction.
