There are 3 forms of organizations permitted to undertake public charitable activity in India i.e. Society, Trust or Section 8 Company and governed by respective constitution laws. For society, you need to register under Societies Registration Act 1860 and separate state society act if applicable for that state. For Trust, trust deed and not trust is registered under Indian Trust Act 1882 or under the state specific Trust Act. A section 8 company is issued license and incorporation certificate under Companies Act 2013. The documents and registering authorities are different. Based on the features of the type of entity best meeting your requirements, you can setup a not-for-profit entity.
