Society Members change approval notice received from MHA

Society Members change approval notice received from MHA. Does it have to be shared with SBI, New Delhi branch where FCRA account is opened? If yes then please elaborate procedure. (Clarification: No change in FCRA signatories).

Yes, the approval of Form FC 6E by MHA is to be submitted to SBI NDMB (FCRA branch).

-If the change means change in signatories in FCRA account, necessary formalities and KYC will have to be done to enable the new signatory to operate the account.

-if the change does not change signatories in FCRA account, the approval of 6E will be required during KYC updation by SBI, so better do the KYC updation now.

-please update the Board list with the recant change on NGO Darpan also because SBI will reconcile the Board list with what is contained in Darpna.

Respected,

CS Sharad Bhargava Sir

I, hope you are doing well.

My FCRA registration was cancelled two or three months ago, even though work and fund utilization were ongoing: now, I am unsure how to get the FCRA reinstated.

Please share your views on this matter.

Dhanyawaad !

Thanks for your query. The cancellation order must have cited reasons, if you disagree, please file revision petition online with fees under Section 32 of FCRA within one year of order and present your case for consideration by competent authority. At this stage, this is the option. If you do not file for revision order, fresh registration would be possible after 3 years from cancellation.

Thank you for your valuable feedback, :folded_hands: :folded_hands:

Sir, I have one more question: funds were received in the Delhi SBI branch before the FCRA registration was cancelled and are still lying there—can I withdraw them?

No, since MHA must have already directed SBI NDMB to freeze your FCRA account for banking transactions. Further, upon cancellation, receipt and utilization of FC funds is not allowed.
