The primary difference between a full time and part time employee concerns the period and possibly the scope of work. While a full time employee would normally work 8/9 hours per day as per the hours of work provisions of the now OSHWC code, the contract terms for a part time employee will detail the hours of work, scope of work and benefits thereof. The Labor Codes do not have any specific distention for full time and part time employee. Both are employees and eligible to benefits under law equally. Part time employment is a flexible engagement mechanism and generally detailed in the organization’s HR policy.

Full-time and part-time employees differ mainly in terms of working hours and proportionate compensation. However, under the new Labour Codes, there is no legal distinction based on hours worked—both are treated as employees. Statutory benefits and compliances such as minimum wages, PF, ESIC, bonus, and gratuity apply based on eligibility criteria and wage thresholds, not on full-time or part-time status. Proportionate pay is permitted, provided minimum wage requirements are met. Taxation for both categories remains the same under income from salary.
